1. Ordering

1. The customer is not obliged to make the payment after placing an order.
2. The customer is not committed to anything and can stop paying at any time.
3. Orders will be delivered within the advertised indication on our website, unless there is not enough stock.
4. If the server turns out to be out of stock, it will be delivered within 8 days else a refund will be processed.
5. ChainLinkHosting will do its utmost to ensure that there is always enough stock.
6. Pre-orders can't be refunded

2. Game server

1. If the consumer does not renew the server, ChainLinkHosting is authorized to shut down the server after it has been expired.
2. If the consumer does not renew the server, ChainLinkHosting is authorized to remove all data of this server, 3 days after the server is expired.
3. Support with regard to plugins/resources and code is not guaranteed.
4. ChainLinkHosting is not responsible in case of data loss. The customer is responsible for making backups.

3. VPS

1. The customer is not allowed host or run any websites/programs that are prohibited under law. Such as performing DDoS attacks, hosting child porn content and hosting copyrighted content.
2. The customer is not allowed to send spam from his ChainLinkHosting servers.
3. ChainLinkHosting is not responsible in case of data loss. The customer is responsible for making backups.
4. ChainLinkHosting will not provide support for third-party apps but sometimes we can put you in the right direction.
5. ChainLinkHosting is allowed to suspend the server if there is any kind of illegal acitvity on the server.
6. It's not allowed to mine crypto on a VPS.
7. With a virtual server you share CPU performance with other customers, therefore it's not allowed to use the CPU heavility for extended periods of time (Fair use).
8. It's not allowed to use your VPS as a proxy or tunnel traffic to a server outside our network.

4. Dedicated servers

1. The customer is not allowed to host illegal programs, content or websites.
2. The customer is not allowed to send spam from his ChainLinkHosting servers.
3. ChainLinkHosting is not responsible in case of data loss. The customer is responsible for making backups.
4. ChainLinkHosting will not provide support for third-party apps but sometimes we can put you in the right direction.
5. ChainLinkHosting is allowed to suspend the server if there is any kind of illegal acitvity on the server.
8. It's not allowed to use your Dedicated server as a proxy or tunnel traffic to a server outside our network.

5. Support

1. The customer can open a ticket in our Discord server or send us an email to [email protected] if he has any questions regarding his service.
2. The official (non-SLA) response time of ChainLinkHosting is 24 hours. But in practice this can of course be a lot faster.
3. ChainLinkHosting only offers support on the services provided by ChainLinkHosting.
4. ChainLinkHosting does not provide support for third-party software.

6. Refunds

1. By placing an order, the customer accepts that ChainLinkHosting does not accept any refund request that isn't covered by our refund policy.
2. The customer is entitled to a refund if the services of ChainLinkHosting have an availability of less than 99%, caused by technical issues on our side.
3. Downtime not caused by ChainLinkHosting such as a misconfiguration made by the customer does not count.
4. The customer needs to report a technical issue the the ChainLinkHosting support via the #create-support-ticket channel in our discord server and give ChainLinkHosting enough time to fix the issue.
5. A refund will be denied if the reason for the refund is: "I don't know how it works". The customer is responsible for installation and configuration of any programs or plugins in his server.
6. A refund will be processed within 7 business days.
7. Some countries have a legal period in which the customer can terminate their server without giving any reason. The customer then gets his money back. This is called Right of withdrawal (or herroepingsrecht). By placing an order with ChainLinkHosting, you agree to waive this right.
8. The customer may not refund the payment, through payment services such as paypal by submitting a claim. They must always request a refund via the ChainLinkHosting support.
9. If the customer opens a claim with paypal or opens a dispute at the creditcard provider, ChainLinkHosting may immediately stop and delete the services of the customer without warning.

7. Other obligations of ChainLinkHosting

1. ChainLinkHosting is not responsible for the content that the customer is hosting.
2. ChainLinkHosting will remove illegal content or other illegal applications/scripts that are not permitted by law.
3. ChainLinkHosting is not responsible for data-loss in any case.

8. Force of the majority

1. None of the parties is obliged to fulfill any obligation if it is prevented from doing so due to force majeure. Force majeure means in any case: war (danger), riots, strikes, war, fire, water damage, flooding, atmospheric conditions, prolonged power outages, adjustments or maintenance to the telecommunications network and / or electricity network of others, cable breaks, attacks on a network / server including DDoS and DoS, disruptions in the networks important for ChainLinkHosting, disruptions in communicative connections including telecommunication connections or prevention or refusal / prolonged absence of compliance by suppliers on whom ChainLinkHosting depends on the performance of its work is.

9. Traffic Monitoring and Packet Capture (PCAP)

1. Monitoring and Inspection: By using ChainLinkHosting's services, you acknowledge and agree that ChainLinkHosting may monitor, capture, and inspect network traffic, including packet data, transmitted through our servers. This is done to maintain the integrity, security, and performance of our systems.
2. Consent: Your continued use of ChainLinkHosting's services constitutes explicit consent to the monitoring of your network activity for the purposes stated above. You agree that failure to accept this may lead to the suspension or termination of services.
3. Legal Compliance: ChainLinkHosting may provide monitored data to law enforcement or other governmental agencies as required by law or in response to valid legal requests.
4. Prohibited Interference: You agree not to interfere with or attempt to evade ChainLinkHosting's traffic monitoring mechanisms. Any such actions may result in immediate termination of services without prior notice.

10. Changes in the terms and services

1. ChainLinkHosting is allowed to change the terms and services at any time.
2. ChainLinkHosting has to announce every change in the #announcements channel in it's Discord server.
